Skyvia is a flight simulation enhancement application that provides AI-powered pre-flight dispatcher calls. The App integrates with SimBrief to analyze flight plans and deliver immersive briefings to enhance your flight simulation experience.

3. User Accounts

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must provide a valid SimBrief User ID to use the service.
• You are responsible for all activities that occur under your account.

4. SimBrief Integration

• The App requires integration with your SimBrief account.
• You must have a valid SimBrief account to use this service.
• We are not responsible for SimBrief service availability or data accuracy.
• You grant us permission to access your SimBrief flight plans for the purpose of providing our services.

5. AI-Generated Content

• The App uses artificial intelligence to generate dispatcher briefings.
• AI-generated content is for entertainment and simulation purposes only.
• Do not rely on AI-generated briefings for real-world flight operations.
• All real-world flight operations must follow official aviation regulations and procedures.

6. User Conduct

You agree NOT to:

• Use the App for any real-world aviation operations.
• Attempt to reverse engineer or hack the App.
• Share your account credentials with others.
• Use the App in any way that violates applicable laws or regulations.
• Attempt to overwhelm our systems with excessive requests.

7. Intellectual Property

• All content, features, and functionality of the App are owned by Skyvia.
• You are granted a limited, non-exclusive, non-transferable license to use the App.
• You may not copy, modify, distribute, or create derivative works without our permission.

8. Data and Privacy

• We collect and process your data as described in our Privacy Policy.
• Your flight plan data is processed to provide dispatcher briefings.
• We use Firebase services to store and manage your data.
• You can delete your account and data at any time through the App settings.

9. Pricing and Payments

9.1 Free Tier

The App offers a free tier that includes unlimited flight plan monitoring and 1 free dispatcher call.

9.2 Pro Tier (Subscription)

The Pro tier is available as a subscription at $9.99/month or $79.99/year and includes:

• 20 dispatcher calls per month
• AI flight advisor consultations
• Random event scenarios
• Post-call note-taking

9.3 Payment Processing

All payments are processed securely through the Apple App Store or Google Play Store, subject to their respective terms and conditions.

9.4 Cancellation and Refunds

You may cancel your subscription at any time through your App Store or Play Store account settings. Refunds are handled according to Apple App Store and Google Play Store refund policies.

9.5 Pricing Changes

We reserve the right to change pricing at any time. You will be notified of any price changes before your next billing cycle.

10. Disclaimers

• THE APP IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND.
• We do not guarantee uninterrupted or error-free service.
• We are not responsible for any damages arising from your use of the App.
• This App is for FLIGHT SIMULATION ONLY and must never be used for real aviation.

11. Limitation of Liability

To the maximum extent permitted by law, Skyvia shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the App.

12. Third-Party Services

• The App integrates with third-party services including SimBrief, ElevenLabs, and Firebase.
• We are not responsible for the availability or accuracy of third-party services.
• Your use of third-party services is subject to their respective terms and conditions.

13. Termination

• You may terminate your account at any time through the App settings.
• We may suspend or terminate your account if you violate these Terms.
• Upon termination, your right to use the App will immediately cease.

14. Changes to Terms

• We reserve the right to modify these Terms at any time.
• We will notify you of material changes via email or in-app notification.
• Continued use of the App after changes constitutes acceptance of new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws.
